v.

OCEAN BEACH AND BAY CLUB, a New Jersey Corporation, Defendant-Respondent

This is a very important case that we won both in the lower court and on appeal. The case tested decisions the Board had made about construction rules after Superstorm Sandy. The Superior Court of NJ, Appellate Division, reaffirmed that a Board of Trustees, much like the Board of Directors of a corporation, has a fiduciary relationship with its members. When a Board of Trustees is empowered to make decisions for the Community, those decisions are protected if they are made in good faith. The court found that the rules the Board had made in this case were “a proper exercise of authority designed to maintain the property rights of members.”
